Credit compliance, kept current
Every obligation under our credit licence dated, assigned and reviewed by a named person – with bespoke compliance monitoring and review software behind it.
- Obligations assigned: Each compliance task carries an owner and a due date, so nothing sits in a shared inbox waiting for someone to claim it.
- Monitoring and reviews logged: Complaints, hardship, breaches, conflicts and credit assessment reviews held as live registers, each entry reviewed and dated as it happens.
- Evidence on demand: A dated record of what was done and by whom, exportable when ASIC, a funder or an auditor asks.
ACL questions, answered
Licensing basics
What types of lending require an ACL?
An ACL is required for consumer credit activities – lending to individuals for personal, domestic or household purposes, or for the purchase or improvement of residential investment property. Business-purpose lending to companies generally does not require an ACL, though the purpose of each loan must be clearly documented.
The NCCP & responsible lending
What is the National Consumer Credit Protection Act (NCCP)?
The NCCP Act is the primary legislation governing consumer credit in Australia. It requires all credit providers and intermediaries to hold an ACL (or operate under one), meet responsible-lending obligations, provide mandated disclosure documents and conduct ongoing compliance. FundPro assists you to meet these obligations.
What are responsible lending obligations?
Responsible lending requires you to make reasonable inquiries about a borrower’s financial situation and objectives, assess whether the credit product is not unsuitable for them, and keep records of your assessment. These obligations apply to each loan written and are a core requirement under the NCCP Act.
What is a Responsible Manager under an ACL?
ASIC requires every ACL holder to have a Responsible Manager – an individual with the knowledge and experience to oversee the credit activities being conducted. As licensee, we hold that function: a nominated director with the required credit experience oversees activities conducted under our licence.
Getting set up & ongoing
How quickly can I get set up as an ACR under FundPro’s ACL?
The ACR route typically takes 3–4 weeks from engagement to going live. This covers the scoping call, credit-policy documentation, ACR agreement, ASIC registration and compliance briefing.
What if I want my own ACL down the track?
FundPro can support you through the full ACL application process when you are ready. The credit policies and compliance framework established during your ACR arrangement serve as a strong foundation for your own licence application.
What is a CL13 and do I need one?
Form CL13 is the notice a credit licensee lodges with ASIC when it enters into – or ceases – a servicing agreement with a special purpose funding entity. It is a notification, not an exemption or an approval. Why it matters: a special purpose funding entity used to fund your loan book can generally avoid holding its own credit licence where a licensee performs the credit activities under a servicing agreement. If your structure uses a funding vehicle, we act as servicer and lodge the CL13 within the required period – no later than 20 business days after the agreement is entered into. Whether this applies to your model is assessed at intake.
What compliance obligations will I have day-to-day?
The primary obligations are conducting proper credit assessments for each loan, maintaining loan documentation, meeting disclosure requirements, and reporting material issues or product changes. FundPro manages the licence-level obligations, compliance monitoring and annual review.
Credit function & compliance
What does an outsourced credit function actually cover?
It is the compliance operation behind your lending, rather than the lending itself. We help write your credit policy and responsible lending procedures around how you actually originate. We can provide assessment templates and record-keeping, the disclosure documents required at each stage, hardship and complaints handling, periodic file reviews, breach identification and reporting, and the annual compliance review. You keep the credit decisions, the pricing and the customer relationship. What you are outsourcing is the obligation to have all of that documented, operating and evidenced.
Who can be a Responsible Manager for a credit licence?
A Responsible Manager is a natural person – not a company – who meets ASIC’s knowledge and experience requirements in RG 206 and genuinely oversees the credit activities conducted under the licence. In practice that means relevant qualifications plus documented years in credit, and enough involvement to actually supervise. It is the requirement that most often stalls an ACL application, because ASIC tests whether the person is real, available and appropriately experienced rather than a name on a form. Under an ACR appointment the function sits with the licensee: our nominated director supervises the activities you conduct under our licence, so you are not recruiting an RM or evidencing organisational competence yourself.
